NYT v. Microsoft Discovery Phase Signals Litigation Now Substantive

A compel order is a judicial finding, not just a scheduling event. When a federal court issues one, it has already determined that the resisting party had no valid objection sufficient to withhold the demanded material. Microsoft's position — whatever it was — did not survive scrutiny. The Times now receives discovery it was refused, and Microsoft is on record as having required a court order to provide it.
